Many people choose to build or improve their homes by hiring a construction contractor. Unfortunately, sometimes these contractors are unlicensed or deceptive in their practices. If the workers who have improved your property are not paid in full, they may claim part of your property is rightfully theirs. The suppliers of the materials used to improve the property are also entitled to this protection. Even if you paid the contractor the full amount of doing the work, the workers or suppliers may not have seen any of that payment. Similarly, if you don't pay the contractor, they have a claim to your property as their payment. his is a tricky situation that costs consumers a considerable amount of money, possibly leading to foreclosure, tax problems, and bankruptcy. 
 
How to Protect Yourself
 
A construction attorney can write a Waiver or Release of Liens form to protect your investment. This document removes the threat of liens against your property by requiring subcontractors or suppliers to sign and release their right to file a lien. Additionally, it is wise to collect a list of suppliers and subcontractors that the contractor will be using. When the project begins, you are required to file a Notice of Commencement form in addition to a building permit. This form contains the location of the property, intent to begin improvements, description of the work, property owner, contractor, lender, and other information. The more paperwork that has this information, the stronger your case may be in the event a lien is claimed. More information can be found here
